Should I Worry About Prop 65 Warnings On Products

If youve gone shopping at all lately, you might have noticed a growing number of products bearing the Proposition 65 warning, which states that the product contains chemicals known to cause cancer in the state of California. Sounds concerning, right?

Prop 65 is over 30 years old, established in November 1986 in California also known as the Safe Drinking Water and Non Toxic Enforcement Act of 1986. The law was originally meant to protect Californians from pollutants in drinking watera response to a series of oil spills and reports of chemical contamination risks in the state.

The act requires products sold in the state of California to include prominent warning labels if they contain any of a list of a extensive list of ingredients known to cause cancer, reproductive harm, or birth defects.

But should you worry if you see a Prop 65 label on a product? Lets find out.

Now What About My Luggage

Could my luggage with a Prop 65 label really increase my chance of cancer or cause me reproductive harm?

Maybe, maybe not.

My specific piece of luggage has chemicals that may increase my risk of cancer or reproductive harm. But nobody really knows for sure if those chemicals will up my health risks.

By the way, another person asked a similar question on another health site. The respondent suggested the Prop 65 warning label was probably listed to help reduce the risk of lawsuits.

So is the Proposition 65 warning label a sign of real danger or is it to help save companies from lawsuits?

Is There A Relationship Between Pregnancy And Breast Cancer Risk

Studies have shown that a womans risk of developing breast cancer is related to her exposure to hormones that are produced by her ovaries . Reproductive factors that increase the duration and/or levels of exposure to ovarian hormones, which stimulate cell growth, have been associated with an increase in breast cancer risk. These factors include early onset of menstruation, late onset of menopause, and factors that may allow breasttissue to be exposed to high levels of hormones for longer periods of time, such as later age at first pregnancy and never having given birth.

Conversely, pregnancy and breastfeeding, which both reduce a womans lifetime number of menstrual cycles, and thus her cumulative exposure to endogenous hormones , are associated with a decrease in breast cancer risk. In addition, pregnancy and breastfeeding have direct effects on breast cells, causing them to differentiate, or mature, so they can produce milk. Some researchers hypothesize that these differentiated cells are more resistant to becoming transformed into cancer cells than cells that have not undergone differentiation .

Safety Of Using A Luggage With The Prop 65 Warning

I recently bought a luggage set from Nautica and it came with a “California 65 warning: This product contains chemicals known to the state of California to cause cancer and/or birth defects or other reproductive harm.”

Is it safe to use? I won’t “eat” the luggage or anything similar, but is it possible to be affected just by being in contact with it?

I know that many products receive this warning in California, but it doesn’t specify how carcinogen it is.

A California Proposition 65 warning doesn’t really tell you anything about the safety of the luggage.

Proposition 65 requires warnings if somebody may be exposed to a substance that has a 1 in 100,000 chance of causing cancer over the course of 70 years, or has the possibility of causing birth defects or reproductive harm, as determined by the California Office of Environmental Health Hazard Assessment.

I think the currently accepted answer is incorrect on a number of points. The official California Proposition 65 site FAQ, has more accurate information. There is also another FAQ from the Attorney General, which answers the question as well. The OEHHA site says:

Q Can I Remove The Prop 65 Label From My Products

A. If a product is found in California, no matter how it got there , it is likely covered by Californias laws. A potential exception would be if you can guarantee that a labeled product will not go to California under any reasonably foreseeable circumstances. For instance, if an electronic device is labeled with a warning sticker and is then shipped to a country and matched with a plug whose physical configuration does not align with an electrical outlet found in California, it may be reasonable to assume that the device will not subsequently ship to California. In this case, it may be acceptable to remove the warning label.

Good Intentions Gone Overboard

To say theres been some backlash is an understatement.

On Reddits Ask an American page, a mildly concerned Scandinavian wondered last year if they should be worried about the Prop 65 warning label on a newly purchased computer part. Dozens of people chimed in, nearly all categorically dismissing the concern. California slaps that sticker on literally everything, wrote one poster. Its a total and complete joke at this point, wrote another. The intention was good but really all it actually did was cause prop 65 labels to appear on EVERYTHING, yet another wrote. As long as youre not eating that dvd reader youre probably fine.

So how did Prop 65 go from public health idealism to punchline? Experts say that while the policy was originally meant to nudge businesses to reformulate their products to make them safer, most businesses find it is cheaper simply to proactively label products instead. Thats led to the current reality of the California marketplace, where consumers are bombarded by so many warnings that theyve learned to ignore them.

The American Chemistry Council, an industry group representing manufacturers of many of the chemicals on the Prop 65 list, did not respond to multiple requests for comment.

Finally, bear in mind that businesses are also exempt from the warning requirement if the degree of exposure to any given chemical is so low as to create no significant risk of cancer, birth defects, or reproductive harm. As such, where you do see a warning, its usually best to stay away from that product and choose one that adheres to Prop 65.

What Chemicals Are Covered By Proposition 65

Proposition 65 requires that the Governor of California maintain and publish a list of chemicals that are known to cause cancer, birth defects and/or other reproductive harm. The list, which must be updated annually, includes a wide variety of chemicals that can be found in many everyday items. There are currently more than 900 chemicals that are listed for purposes of Proposition 65.

How Does Prop 65 Affect Clothing Distributors And Manufacturers

In June 2010, a coalition of more than 40 retailers and clothing manufacturers settled a class-action lawsuit for $1.7 million dollars. The goal of that lawsuit was to limit the amount of lead in handbags and other accessories. A direct result of that lawsuit was the establishment of lead concentration levels for various fashion items, including bags, shoes, and more. As consumers become more aware of the dangers of different chemicals and compounds, their demand for safe products will only increase.

Part of the problem with Prop 65 is that the burden of responsibility falls on everyone involved in the manufacturing and distribution of clothing and accessories. Apparel-makers and suppliers can’t claim ignorance because they could be liable if they fail to adhere to the law. Otherwise, retailers may refuse items from suppliers that can’t prove their goods don’t contain cancer-causing chemicals.

What Is California Proposition 65

The official name of this law is the Safe Drinking Water and Toxic Enforcement Act of 1986. However, everyone refers to it as Prop 65 since that’s what it was on the ballot.

Since its inception, Prop 65 has affected virtually all businesses and corporate entities in the state. The primary purpose of the law was to ensure that “no person in the course of doing business shall knowingly and intentionally expose any individual to a chemical known to the state to cause cancer or reproductive toxicity without first giving a clear and reasonable warning.” But, does Prop 65 apply to apparel? Yes, it does.

The Act is one of several “right to know” laws that aim at providing consumers with as much information about the products and services they buy. Since dangerous chemicals and elements are present in many industrial practices, they can wind up in all kinds of items. Companies must notify their customers of the presence of these compounds so that consumers can make informed decisions.

The primary elements that Proposition 65 focuses on are lead, cadmium, and phthalates. However, the current chemical list contains more than 900 chemicals, and more are added regularly. The list gets released every year, and companies have 12 months to adapt to face the consequences .

Does This Warning Mean That Our Products Are Unsafe

How To Cope With Prop 65

When the Proposition 65 labels started appearing just about everywhere by the end of the 1980s, a public health scare flourished.

Some think the Prop 65 labels have desensitized the public, or have caused undue hype. If the Prop 65 warnings are everywhere, then perhaps that opinion is merited by some.

Is there a reasonable extent to which Proposition 65 can protect the public without scaring people into hibernation?

Im no lawyer. Nor am I a health professional. So Im not the right person to answer that question.

Coming from a family with a long line of cancer and as someone with a desire to father healthy children someday, I certainly dont laugh in the face of health labels and I respect their intent.

Thanks to the rise of health warning labels over the last several decades, society is more aware of the dangers of smoking, drugs, alcohol, lead paint, and so many other commonly encountered hazards.

While merely touching my luggage may not cause cancer or other serious health problems, its important to know that there are some pretty toxic chemicals out there and that they may be part of my everyday life.

Its impractical to totally rid my life of everything that could cause the serious health issues that Prop 65 warns of. But at least I have more knowledge about whats in the products Im buying giving me a better ability to understand what everyday items may be potentially problematic to my health and inspiring me to find safer, cleaner alternatives.

It might surprise you to learn that Prop 65 is more than 30 years old! Passed in 1986 by voters in California, Proposition 65 is an initiative aimed at addressing concerns about exposure to toxic chemicals. Prop 65 is also known as the Safe Drinking Water and Toxic Enforcement Act of 1986.

This act requires that businesses selling products in California include warnings for products that contain significant amounts of chemicals that are known to cause cancer, birth defects, or reproductive harm. The act also prohibits companies from knowingly discharging chemicals from the Prop 65 list into sources of drinking water.

The Office of Environmental Health Hazard Assessment administers the Proposition 65 program. Each year, the OEHHA evaluates current scientific evidence and updates the list of chemicals. Businesses With Fewer Than 10 Employees Exempt

Second, businesses with fewer than 10 employees, and government agencies, are exempt from Prop 65s warning requirements and prohibition on discharges into drinking water sources. Why the government would be exempt from the requirements is beyond me shouldnt government lead the way in promoting safe products and manufacturing practices?

It does make a certain kind of sense, however, to allow smaller companies to avoid the onerous costs of testing. That said, if youre buying from smaller, local companies, consider asking them directly if their products adhere to Prop 65 regulations, even if they dont carry official certification. Their willingness to respond, and their response itself, will likely offer a good indication of whether to trust their products.
